2. Service Description

DomainOutreach.com provides domain outreach services, including but not limited to researching potential buyers for domain names, creating lead lists, and conducting email outreach campaigns on behalf of domain owners. Our services are intended to help connect domain owners with potential buyers.

3. User Responsibilities

By using our services, you represent and warrant that:

• You are the legal owner of the domain(s) you submit or are authorized to act on behalf of the owner.
• The domain(s) you submit do not infringe on any third-party trademark rights.
• You will provide accurate and complete information about your domains and pricing expectations.
• You will respond promptly to interested buyers generated through our outreach efforts.
• You will not use our services for any illegal or unauthorized purpose.
• You will comply with all applicable laws regarding domain sales and transfers.

4. Payment Terms

Our service fees are clearly outlined on our pricing page. By purchasing our services, you agree to the following payment terms:

• All upfront fees are non-refundable once we have begun work on your domain outreach campaign.
• Success fees (10% of sale price for Basic plan customers) are due within 7 days of completing a domain sale that resulted from our outreach efforts.
• You agree to notify us promptly if a domain sells to a lead we provided.
• We reserve the right to change our pricing at any time, but changes will not affect existing paid campaigns.
• By using our Basic plan service, you agree to pay a 10% success fee on any domain sale that results from leads we provide, regardless of when the sale occurs. This success fee applies to the full sale price and is due within 7 days of completing the transaction.

5. Service Limitations

While we strive to provide high-quality outreach services, we cannot and do not guarantee:

• That your domain will sell as a result of our outreach efforts.
• A specific number of leads or responses for any given domain.
• The quality or accuracy of all leads, despite our best efforts to verify them.
• Any specific timeline for domain sales.

Our service is limited to outreach and lead generation. We do not act as brokers, negotiators, or intermediaries in domain sales unless explicitly agreed upon in writing.

6. Intellectual Property

The DomainOutreach.com website, logo, and all content, features, and functionality are owned by DomainOutreach.com and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without our express written consent.

7. Limitation of Liability

To the maximum extent permitted by law, DomainOutreach.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our service.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service.

8. Indemnification

You agree to defend, indemnify, and hold harmless DomainOutreach.com, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your domain infringes upon someone else's trademark or intellectual property rights.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
